The lawyers’ order resent the arrest of Manandafy’s attorney

 

President Hery Rakotomanana appeared very critical about the investigation procedure concerning Master Noro Rabemananjara. Manandafy Rakotonirina’s lawyer underwent a search and then joined her client in detention. 

The Noro Rabemananjara cas only emphasizes the idea that political lawsuits encourage the auhorities to violate the State of Law. Bar’s president Hery Rakotomanana resented the continuing wrong doing, particularly against one of his colleagues 

Manandafy Rakotonirina’s lawyer joins her client in jail. The “legalistic” Prime minister designated by the elected president Marc Ravalomanana has been incarcerated after his  brutal arrest by “commander Charles”‘s investigation commission squad at the transition authority’s service. Master Noro Rabemananjara is facing five charges which all concern alleged threats to national security. 

In clear, the suspect’s defender becomes an accomplice. The lawyers’ order’s president’s criticisms concern the search and investigation procedures of Master Rabemananjara. The investigators only proceeded with the suspect’s consent, the suspect in question being someone else’s lawyer. Their pretext was the fact that the Bar’s president couldn’t be joined by phone. 

Master Hery Rakotomanana strongly disagrees. “An official letter should have been mailed to the lawyers’ order”, he argued. The Bar’s president recalled that he is not the only one to address in order to lead a search in a bar’s member’s office. The appeal court’s first president must give his opinion then, the attorney general must sign a mandate. He denounced the investigators’ accomplished fact. “The mandate came too late to me”, he revealed. 

Serving as a lawyer is becoming so much more and more complicated in this political crisis context to such point that bar’s members made a sit-in in front of the court of Anosy. The men in black demonstrated to challenge the judicial system and to claim more weight to the increasingly entrenched defence. The order also turned down the reinstatement of three lawyers previously expelled from the bar for ethics violation. 

The famous colonel Richard Ravalomanana, as the investigators’ chief in political cases, gave in to criticisms by recognizing some procedural mistakes, and even conceding that they could reveal a certain legal incompetence. With such pressure on lawyers’ backs, fair processes are become quite controversial.
