a politically motivated nomination on top of the State Council

The State Council is not judge and issue all the way every so often. M. Hanitra Razafimantsoa lodged the opposition to the Max Ramilison’s appointment in court. The attorney denounced a violation of the fundamental law stipulating that the State Council’s president can only be appointed by a vote from his peers. She subsequently made public that the operation had nothing to do with hazard. The forthcoming decisions from the dictating authority would make no place for any eventual opposition.  

The State Council’s new president’s political inclination is emphasizing suspicion. Max Ramilison is actually famed for being part of Norbert Ratsirahonana’s party, the AVI allied to the TGV. The Council of state previously directed by Noro Robinson had rendered several decisions challenging the HAT and its governments. Prior to the leading figure change, the HAT had made sure to inflict changes of its choice upon the fundamental law itself. All of the authorities’ decisions are, from then on, labeled as government acts. Only the High Constitutional Court will be entitled to have say about them in quality of a far more obedient institution. The Rajoelina regime is going as far as imposing the everlastingness of its laws. This latest judicial battle might be a far more significant stake than the appointment of a PDS in replacement of an elected mayor. 

In any case, Max Ramilison is a brilliant magistrate perfectly matching the position’s suit. According to the HAT Justice minister, Christine Razanamahasoa, the man has been proposed by the Judicial Superior Council. She immediately put this institution’s alleged independence forward in order to block any attempt to evoke the calculated manipulation. “Ramilison Max is the highest ranked officer of the administrative jurisdiction” she argued. “We are considering the rank and the experience but not the political inclination”, she desperately insisted. But the State Council’s legitimacy and neutrality are to be seriously undermined by its president’s political obedience.  

Max Ramilison did not argue much longer about it. During his official entry statement, he shared his priorities on top of the State Council: the reshuffle of the institution, the training of young magistrates, and the improvement of the judicial library are program’s headlines. Does the appointment of the State Council’s present depend on a government act from now on? The HAT response: deal with what’s done your way.  Max Ramilison presented his solemn oath despite legal opposition lodged at the…State Council. Having a judge making a decision for or against the appointment of his own acting and politically supported president would be a second to none scene. The HAT is, henceforth, able to fire and replace any official of this island at will.
