The complicated operation obviously gave birth to a malformed national independent electoral commission. For lack of proposals from the opposition, three out of this organ's nineteen members have failed to be designated. The HAT is naturally holding the opposing three mobilities as responsible for this failure.

An incomplete and “non consensual” CENI and its very complicated birth

The CENI’s constitution has been made official by the order number 2010/142 from a Cabinet meeting. This hasty erection is, however, undermined by the opposition’s absence. The HAT is already breaking its own rules from its Teny ifampierana, and the devil with the widened consensus! The opposition definitely boycotted the HAT electoral institution related talks. The Rajoelina mobility’s political calculation has, consequently, slightly been spoilt, although the refusal was expectable since the HAT officially addressed the three pro-Maputo mobilities. Following the raging reaction to the African Union’s sanctions calling upon retaliation against Marc Ravalomanana, Didier Ratsiraka and Albert Zafy, boycott became a done deal.  

 

However, the HAT is striving to make an asset of the opposition’s voluntary abstention, a way to reject any blame on someone else in front of the international community continuously appearing merciful despite all the so-said national sovereignty HAT shows. The Rajoelina mobility is anxious to get a unilateral move on, namely by receiving oath from members of the incomplete CENI. The imposition of a second order would have been more suited to the institution’s completion. Such a lack of patience is displaying the HAT determination to move forward in the preparation of any election. Unfortunately, a slanting CENI can hardly pledge any national unity, and jeopardizes its potential independence. Ambohitsorohitra is, however making a fuss of the three mobilities’ absence. 

 

The legal basis of law texts drafted by the HAT is as controversial as quick sand. Their authors are themselves losing their way in their own unilateral maze, but keep on running ahead at full sail. First, one of Andry Rajoelina’s personal order reshuffling his transition, casting the Maputo Charter, which he signed, aside, then a self made debate claiming a widened consensus to validate the HAT roadmap, and finally opinion from a HCC believing the HAT made CENI to be fully complying with the Malagasy Constitution previously set out of order by Rajoelina’s personal order; everything is virtual, the judicial decoy is far from convincing. The erection of the CENI ought to have been the capitalization of a political common will to lead to free and fair elections. This CENI is not.

 

The electoral Commission is supposed to take over the Home Affairs Ministry in the electoral settings. The HAT vice premier believed his mission to be completed. Let’s “let the CENI freely work, its processes’ follow-up is our duty, the Home Affairs Ministry is wishing it good luck “, he declared. In the real world, the transitional junta will keep in control of most of the vote’s organization and process. The CENI would definitely be effective, but its real time capacity will still be controversial.
