The new proposition covers quite a large range of infringements. Embezzlements committed while in charge, corruption, perception of undue rewards by public civil servants, breach of customs, foreign trade and tax legislation and regulation… the list should reassure many politicians worried by justice at every regime change in the country.
If the law is adopted in this very improved version, the politicians concerned by other «more serious” infringements, will be able to seize the National Commission of Reconciliation (CNR). They would defend their file by evoking a politically motivated condemnation and by calling for a re-examination of their legal situation. It concerns condemnations of money laundering, forgery, classical criminal activities as the traffic of narcotics or criminal complicity…
The question related to attempts to the physical integrity of people remains fuzzy. Losses of lives have been provoked to politically trap statesmen. Those heavy charges would be dropped considering that responsibility is shared between the leaders of the crowd in a red zone and the defenders of an institutional facility.
The law of the amnesty is on the other hand clear the condemnation of war crimes, genocide and crimes against the humanity. Neither bloody crimes nor serious violations of human rights and fundamental liberties will be erased. This text is hardly accepted by all, particularly by the transitional power, because it doesn’t permit to eliminate some political adversaries. Yet it’s been conceived to encourage the process of political appeasement and national reconciliation.
