The February 07th file, the Rajoelina mobility’s non secret weapon,

« We have to stick to what is written and to avoid that mobilities make their own interpretations of the agreement signed in Maputo « . The HAT camp tries to impose its point of view about the negotiations’ outcome claimed as a success. The symbol of this victory would be the non amnesty for the elected president Marc Ravalomanana. 

The judicial mist appeared immediately at the delegations’ return in Antananarivo. Fetison Andrianirina announced the satisfaction of the Ravalomanana mobility, affirming that the president will be able to come back to the country in appropriate time and that he will be able to participate freely in the next presidential election. In the HAT camp, the sparkle is being mastered before it turns into a fire.  

Ny Hasina Andriamanjato’s clarifications are calling in the very existence of an agreement on the Ravalomanana case. The latter has so far been condemned for a very political file concerning a fact back in 2008, that is to say the purchase of a plane for the presidency. The HAT foreign minister insisted that other files about facts back in 2009 could still catch up the president. 

They concern the repression of the popular Coup on February 07th 2009, when the TGV movement tried to enter the presidential palace by force. Full transparency over this case is far from being established concerning the responsibility of leaders, attackers and defenders the institution’s highest symbol. The origin of the deadly shootings is still to clarify since only 18 bullets have been shot from the palace, according to an official report. 

The biggest political victory of the movement aiming to oust the Ravalomanana regime was the entrapment of a presidential guard which only completed its duty by defending the presidential palace against a hostile crowd. A remake of August 10th 1991 is being used to ruin the president’s reputation and get a long term legal weapon; although the political calculation didn’t have the expected impact yet. The signature of an agreement on the Ravalomanana case and the political convicts of 2009 could question an objective that required sacrificed lives. 

Should slaughter be pardoned? There have actually been slaughters, on August 10th 1991 as well as on February 07th 2009? Today’s worry is not to encourage impunity for leaders or police forces assigned to defend an institution. Do we just not risk encouraging political leaders to use crowds as human shield in order to trap state officials and justify putsches? 

However that may be, the HAT and the Rajoelina mobility are drawing the February 07th file against president Ravalomanana. The HAT is threatening to use the judicial weapon to deter the ousted president from coming back to the country, whatever the concluded political agreement. According to the agreement, Marc Ravalomanana should be able to go back as soon as the political situation is appeased. « The amnesty can concern judged facts as well as other ones », warned Ny Hasina Andriamanjato. He made it clear that the Malagasy justice is free to comply, or not, with the Maputo agreement over the cancellation of pursuits against Marc Ravalomanana and the members of his mobility. It means that negotiations continue and the second appointment in Maputo ought to clarify things.
