Suspicions on the involvement of extra big fishes were raised by the imposed authority´s surprising low profile following the seizure of rose wood in the Comoros. The very same authority is now deflecting the attention on relatively irrelevant musclemen in the run of a second smaller seizure in Mauritius. Andry Rajoelina decided to by pass the legal authorities and impose its own laws in a quick cabinet meeting.

Rose Wood saga: the HAT´s laws to protect and serve… its own self

The crisis situation turns each and every motion in an excess of goodwill putting political power above the rule of laws. The HAT is straining to overtake the roles of investigator, attorney general and judge in the run of the latest rose woods seizure case. Andry Rajoelina produced clear instructions”, in order to put an end to rose wood smuggles” 

 

“whoever is recognized als involved in a rose wood smuggle, must be systematically detained and, in case of undeniable charges, condemned to a severe judicial sentence. Firm instructions in this sense have been given to the Justice minister so that prosecutions go this way countrywide”. And the hell with the Justice´s independence. The TGV minister will oblige as per usual. 

 

For the sake of enforcing his version of a due sentence deemed to sanction the economic crime related to the rose wood smuggle, he would merely have to order his parliament to alter the laws. Andry Rajoelina does even not resort to a signed order.

 Quite not legal laws 

 

“Law texts related to rose wood smuggle must be largely, regularly, nationally and internationally let known”, ordered the imposed authority´s leader to his minister in charge of communication. Andry Rajoelina has repeatedly recalled the so far poorly watched ban on cutting, transportation and export of rose wood.     

 

The foresters´union gently addressed the HAT while keeping away from confronting it, concerning the state´s intended sell of seized rose wood in order to refill its accounts. It did namely recall that existing laws could possibly not be breached but by another law. And the so named existing law is arguing that only the forest resources management authority is allowed to resell potentially seized rose wood cargo and use the collect money to contribute to forest resources management. 

 

The HAT´s latest extra cabinet meeting which mainly focused on the rose wood case recalled that the cutting and export of this state owned national wealth were definitely prohibited. The régime is in for turning into a criminal and ordered the concerned ministries to draw up an inventory of available rose wood stocks up to August 31st, 2011. Besides, ” each and every civil servant linked either to the Customs or to environmental authorities, as well as to the rose wood smuggle, must be systematically held in custody, and, could the incriminating proofs prove enough, be condemned to severe jail sentences  “. The political speech is apparently intending to pressure the judicial authorities too. 

 

The imposed authority actually intends to erect its own exceptional court deemed to implement its vision of justice. The HAT is resorting to whatever means for the sake of appearing as a regime fiercely fighting against the depredation of natural resources, and  abuse the unblured international community if ever possible.
